Subject: Government interference in Quinn situation



An Taoiseach,

I have communicated with you on numerous occasions to request that you intervene to protect the Quinn Group and Quinn Insurance in the best interest of the taxpayers and also the employees.

At all times, I was mindful of the unambiguous statement that you yourself made in the presence of a number of people, prior to the General Election "it was a disgrace what they did to Sean Quinn - it should be reversed immediately". As the situation deteriorates at an alarming rate, the Quinn Group is now in free fall, the enormous legal costs racked up by Anglo in attempting to defend the indefensible and the bills that are accruing for Anglo spin, the taxpayers of Ireland are being ripped off in a scandal that many predict will bring down this Government.

No doubt, you are aware that Anglo is defying proper procedures in that they are manipulating and leaking legal documents to the media for the purpose of attempting to inappropriately influence the outcome of the largest ever case to come before the Commercial Courts in Ireland. Do Government officials not realize that the dam will burst and all hell will break loose when the Quinn Family tell the true story at the appropriate time? The chairman of the Cross Party, Cross Border Group of politicians who interviewed all parties in this matter has publicly stated that "I warrant there will be a lot of people in privileged positions who will have a lot of questions to answer and will have egg on their faces when the truth is outed"

As you are aware, a proposal was submitted to the relevant agencies within the specified time frame which would have facilitated the return of all monies advanced by Anglo to Sean Quinn, despite the fact there is strong legal advice that the debt could not possibly be legitimate. The proposal would also have protected all the jobs and created 1800 additional posts. 1000 jobs have already been lost with the certainty that thousands more will go under the programme that your Government has sanctioned.

Given that we now know from former Anglo executives that the irregularities and illegal actions by Anglo such as loan warehousing, Maple 10 arrangement etc was done with the knowledge and approval of the Financial Regulator, the Governor of the Central Bank and crucially the Department of Finance and presumably Kevin Cardiff, the man that you are intent of having promoted to a senior position in Europe, it defies belief how anyone who has bothered to get to the bottom of this situation, could possibly believe that Anglo were within their rights to seize the Quinn Group in the despicable manner in which it was orchestrated, not to mention giving away Quinn Insurance for one euro.

A packed public meeting in Co. Leitrim on 21st March 2011 was given a firm commitment by Frank Feighan that no decision would be made until the Quinn Proposal was given proper consideration by your Government and he also promised that Michael Noonan would meet with Quinn Representatives. The level of fury in these communities for the failure to honour commitments made, is at boiling point.

I wrote to Michael Noonan on a number of occasions to ask why he had lied to the Irish People on the 14th April when he stated that the bondholders had taken a write-down in the order of 50% in the Anglo deal on Quinn. We now know and will confirm that they took no write-down whatsoever and that what he told the electorate was a downright LIE.

People initially took the view that he himself may have been misled by Anglo also. However, we must now conclude that since he has steadfastly refused to clarify the matter, there is no evidence for us to believe that he was not deliberately telling a blatant lie to the taxpayers. I now request that you clarify this matter once and for all.

As I already stated, I outlined to you and to numerous Public Representatives the gravity of what is at stake in this situation. Time and time again, I was informed that the Government could not intervene in this situation. (Incidentally, there is now written confirmation from the President of the High Court, that he was influenced by the Minister for Finance in making the decision to approve the transfer of Quinn Insurance to Liberty Mutual).

Bearing in mind the consistent refusal by your Government to intervene in the best interest of the Irish People, I can only say that I was shell-shocked to read in the media that the Irish Government had interfered in Quinn properties in Ukraine and that you yourself had met officials there to discuss the matter. It is an outrage that the Government has refused to act in the proper manner in Ireland with regard to a matter of such enormous public interest with the excuse that it is the remit of the Courts to make the decisions, while the President of the High Court concedes that he has been influenced by Michael Noonan and now we are told that you and Government officials have interfered in a matter in the Ukraine which is strictly a legal matter.

I now request that you clarify this matter along with the lie that Michael Noonan told about the bondholders, by return.
As I stated in previous correspondence, I will be proceeding with an official complaint to the Gardai under the Criminal Justice Act in relation to the reporting of white-collar crime. With this in mind, I request that you retain this email to be used in evidence in this matter.

Finally, it is never the wrong time to do the right thing but the time of no return is here. I hope for the sake of the most vulnerable in our society, and for the survival of the Government that common sense prevails and that you step up and do what you said you would do when you stated that "it was a disgrace what they did to Sean Quinn...........".

I genuinely have absolutely no idea if the Quinn family would even consider entering into any discussions with your Government given the injustice that they have been subjected to, but it is your duty to attempt to rectify the wrong that has been inflicted not just on the Quinn family, the employees who have lost their jobs, but also the taxpayers and citizens of Ireland. The prevailing feeling in the border counties is that the family has the absolute right and indeed duty, to clear their name and recover everything that was illegally and invalidly seized from them (as has already been determined in a court in another jurisdiction) in a deplorable act that was facilitated by this Government.

It must be said also that those who are acquainted with the facts of this story and not relying on the media spin by Anglo, are totally confident that the Quinn family will win the big case next year. They will be able to prove that they did everything humanly possible to prevent any burden being imposed on the taxpayers. What will your excuse be for the unnecessary squandering of billions of taxpayers money.
