The Commercial Court has heard today that the IBRC's special liquidators have not instructed the bank's lawyers on how to proceed in their legal action against the family of bankrupt businessman Sean Quinn.
Mr Justice Peter Kelly has said he has been unable to obtain a copy of the new IBRC act on the Oireachtas website, even though it has been passed into law.
This was the first time the multimillion euro legal battle between IBRC and the Quinn family was before the court since emergency legislation liquidating the bank was passed.
The case was listed today so the parties could agree on a timeframe for further written and oral submissions to be made ahead following the five-day cross-examination of the Quinn children.
Barrister Ailil O'Reilly for IBRC informed Mr Justice Peter Kelly that he has been given no instructions from the special liquidators appointed to wind up the bank.
He was also unable to provide a copy of the wind-up order to the judge who said the new act is not on the Oireachtas website even though it is now law.
"I appreciate it's in the newspapers," the judge said, "but it has to be proved to the court."
He adjourned the case until next Wednesday.
